Two MCD officials summoned for disobeying court orders

[RxPG] New Delhi, May 9 - The Delhi High Court Wednesday ordered the two senior Municipal Corporation of Delhi - officials to appear personally on May 16 for passing an executive order overriding a judicial ruling to seal unauthorised buildings at Rama Road in Central Delhi.
A division bench of Chief Justice M.K. Sarma and Justice Rekha Sharma asked Karol Bagh zone's former deputy commissioner and its additional commissioner to be present in the court to explain why they passed an order to stop the sealing drive in the illegal colony at Rama Road.
The former MCD deputy commissioner had on Feb 19 written a letter to deputy commissioner of police not to send the police force as the sealing drive had been kept in abeyance.
'No such order had been passed staying the sealing at Rama Road area. We are surprised to know how he interpreted our order,' the bench remarked.
'Why appropriate action should not be taken for contempt of court as the order of the court had been violated,' said the bench in its order.
The bench expressed surprise at the MCD official's letter to the police officer, which said that he had 'studied the mind of the court' and the sealing drive had been kept in abeyance till further order.
First the lieutenant governor had directed the authorities not to carry out the demolition drive and even the officials were flouting the order, the court observed.
Now the lower rank officials including inspectors were flouting the judicial orders, it said.
The bench last week had asked the Delhi government to file an affidavit explaining the passage of the lieutenant governor Tejinder Khanna's April 26 order, staying the demolition of unauthorized structures in the urban villages of the capital.
